Introduction

The Skilled Independent (Subclass 189) visa is a permanent General Skilled Migration visa which does not require sponsorship by a State/Territory Government or relative in Australia. 

In order to apply for a Skilled Independent Subclass 189 visa, you must first lodge an Expression of Interest and be invited by the Department of Immigration to apply. 

Once you are invited to apply for a skilled visa, you must lodge your application within 60 days, otherwise the invitation lapses. Accordingly, it is very important that you have all required documentation prepared to lodge as soon as possible after receiving the invitation.

This visa provides the holder with an Australian permanent residency with no conditions. The holder can live and work wherever they like in Australia. Although the visa is granted based on the holder being skilled in a specific occupation, once granted, the visa doesn’t require you to seek or maintain employment in this occupation.

With this visa, you can

  • stay in Australia permanently
  • work and study in Australia
  • enrol in Australia’s public health care scheme, Medicare 
  • sponsor eligible relatives to come to Australia
  • travel to and from Australia for 5 years
  • apply for Australia Citizenship , if eligible

Requirements

This visa is available to applicants who are skilled in an occupation on the Medium and Long-term Strategic Skills List (MLTSSL) (this link to resources)

  • have a suitable skills assessment for the occupation
  • Lodge an Expression of Interest  and be invited to apply
  • meet the points test pass mark of 65 points (check your points)
  • Be aged between 18 and 44 inclusive
  • have Competent English
  • be invited to apply.
  • Meet health and character requirements

How long can you stay?

This is a permanent visa – it lets you stay in Australia indefinitely.

You become a permanent resident on the day the visa is granted.

Your permanent residency for citizenship purposes starts:

  • on the day the visa is granted if you are in Australia
  • on the day you enter Australia on this visa if you are outside Australia

Introduction

The Skilled Nominated (Subclass 190) visa is a permanent visa that allows skilled workers to live in Australia, based on a nomination by an Australian state or territory. This visa is available to applicants who are skilled in an occupation on a state or territory occupation list. Each state or territory has its own list of occupations, state requirements and processes depending on the skill shortages in that area.

In order to apply for a Skilled Nominated (Subclass 190) visa, you must first lodge an Expression of Interest and be invited by an Australian state or territory.

Once you are invited to apply for a skilled visa, you must lodge your application within 60 days, otherwise the invitation lapses. Accordingly, it is very important that you have all the required documentation prepared to lodge as soon as possible after receiving the invitation.

The holder must commit to living and working for at least two yearsl in their chosen state, unless particular circumstances applies. Although the visa is granted based on the holder being skilled in a specific occupation, once granted, the visa doesn’t require you to seek or maintain employment in this occupation.

  • work and study in Australia
  • enrol in Australia’s public health care scheme, Medicare

Introduction

The Skilled Work Regional (subclass 491) Visa is a Temporary Visa which enables eligible skilled workers and their families to live, work and study in designated regional areas of Australia for 5 years. It is available both to skilled workers who are already living and working in Australia as temporary residents and to those living outside Australia. This visa is available to applicants who are skilled in an occupation on a state or territory occupation list. Each state or territory has its own list of occupations, requirements and processes depending on the skill shortages in that area.

Visa holders will be eligible to apply for a Permanent Residence visa after three years. 

In order to apply for a Skilled Work Regional (subclass 491) visa, you must first lodge an Expression of Interest (EOI) and be invited by be nominated by:

  • an Australian state or territory government agency or
  • sponsored by an eligible family member residing in a designated regional area

Once you are invited to apply for a skilled visa, you must lodge your application within 60 days, otherwise the invitation lapses. Accordingly, it is very important that you have all required documentation prepared to lodge as soon as possible after receiving the invitation.

Entitlements

Once a subclass 491 visa is granted the visa holder can remain in a designated regional area of Australia for up to five years, with a permanent residency pathway available after three years. Dependent family members may be included and must also live, work and study in a designated regional area.

With this visa, you can:

Visa holders can move between regional areas. Regional areas are defined as any area excluding Sydney, Melbourne and Brisbane. Important change: Perth and Gold Coast are classified as regional areas. You may work in any occupation and for any employer in line with the work and residence conditions attached to your visa.

IMPORTANT: Holders of the new provisional visas will also be unable to apply for most other visas (subclass 189/190/820/186) in Australia until they have completed at least three years in a designated regional area unless exceptional circumstances exist.

Requirements

To be eligible for this visa, applicants must be skilled in an occupation on the relevant State Government Occupation List and be nominated by that State OR by an Eligible Family Member.

Applicants must also meet the following criteria:

  • meet the points test pass mark of 65 points (check your points)
  • Have a suitable skills assessment for the occupation
  • Lodge an Expression of Interest  and be invited to apply
  • Be aged between 18 and 44 inclusive
  • have Competent English or higher
  • be invited to apply by the State or Territory.

How long can you stay?

This is a temporary visa. You can stay in Australia for 5 years from the date we grant your visa. It allows the applicant to apply for permanent residence after 3 years through the Permanent Residence (Skilled Regional) visa (subclass 191) – which commences on 16 November 2022.

Introduction

The Temporary Graduate Visa (subclass 485) is a work visa for international students who have completed 2 years of study in Australia. It can last from between 18 months and 4 years depending on the course of study completed. The primary applicant must be in Australia when they make their application for a 485 visa and must have held an eligible student visa within the 6 month period prior to lodgement.

There are two Eligible Stream under the Temporary Graduate Visa depending on the course of studies you completed:

  • The Graduate Stream: For international students with an eligible qualification who graduate with skills and qualifications that relate to an occupation on the Medium and Long Term Occupation List. A visa in this stream is granted for 18 months from the date of the grant.
  • The Post-Study Work Stream: This stream is only available to students who applied for, and were granted, their first student visa to Australia on or after 5 November 2011. International students who graduate with a higher education degree from an Australian education provider (Bachelor, Master, etc.), regardless of their field of study, may be eligible. A visa in this stream can be granted for up to four years from the date the visa is granted, depending on the applicant’s qualification.

Whilst on a 485 visa, you have unrestricted work rights in Australia.

With this visa, you can:

  • stay in Australia, usually for 18 months
  • travel, work or study in Australia during your stay

Requirements

This Visa has different requirements depending on the Stream:

General Requirements:

  • You must be under 50 years of age.
  • you must have held a student visa within the past 6 months before your application
  • Apply for the visa from within Australia
  • Have health insurance for the duration of your visa (OVHC)
  • Have English level IELTS 6, with no score lower than 5 (or equivalent English test) – unless you hold a passport for UK, USA, NZ, Ireland or Canada. The English test must have been taken within 3 years of your application
  • Have not previously held the temporary graduate or skilled graduate visa

And:

1).  Post Study Work Stream

  • The qualification that you have completed must be an eligible degree (bachelor degree, masters degree, doctoral degree etc.)
  • you completed your course at the university level as a result of at least two academic years (92 weeks) study
  • you were physically in Australia for at least 16 calendar months to complete the study

2).  Graduate Work Stream

  • Have a degree, diploma or trade qualification closely related to an occupation on the Medium  and Long Term List that occupation
  • Have a Skills Assessment for the occupation from the relevant
  • you completed your course as a result of at least two academic years (92 weeks) study
  • you were physically in Australia for at least 16 calendar months to complete the study

How long can you stay?

Duration of the 485 visa will depend on your circumstances. 

Gradate Work stream visas are valid for 18 months from the date of grant of the application. 

Duration of the Post Study Work (PSW) Stream depends on which qualification and whether you have completed your study in a regional area in Australia. If you study in Melbourne, Sydney or Brisbane your PSW duration will be:

  • 2 years: completion of Bachelor Degree, Bachelor with Honours, Masters by Coursework or Masters (Extended)
  • 3 years: Masters by Research
  • 4 years: Doctorate

c. Secondary applicant under 18: $415.00

Processing Time –  between 90 days to 4 months

Introduction

This visa is for people who have lived, worked and studied in designated regional area Australia on a previous, eligible visa. This Visa will not commence to be in effect until November 2022. The Permanent Skilled Regional Visa (subclass 191) will allow Subclass 494 and 491 visa holders to transition to permanent residency after three years living in designated regional areas. Regional areas are defined as any area excluding Sydney, Melbourne and Brisbane. 

Important change: Perth and Gold Coast are classified as regional areas. You may work in any occupation and for any employer in line with the work and residence conditions attached to your visa.

The 191 Visa is a Permanent Visa and once a is granted, you can:

  • live, work and study in Australia permanently
  • travel to and from Australia as many times as you want while the visa is valid
  • enroll in Australia’s public health care scheme (Medicare) 
  • sponsor your relatives to come to Australia
  • travel to and from Australia for 5 years
  • if eligible, apply for Australian citizenship 
  • Dependent family members may be included and must also live, work and study in Australia.

Requirements

To meet the requirements of the permanent visa (from November 2022) applicants must:

  • held a 491 or 494 visa for at least three years
  • have lived for at least 3 years in the regional areas
  • have a taxable income at or above a specific income threshold for at least three years
  • Holders must show earnings of at least $53,900 annually for three years.
  • complied with the conditions of the regional provisional visas
  • must be inside Australia to apply

How long can you stay?

This is a permanent visa and it lets you stay in Australia indefinitely.

You become a permanent resident on the day the visa is granted.
