Visa Type: Employer Sponsored Visa

Are you an overseas worker that has a full-time employment opportunity in Australia or an Australian employer interested in sponsoring an overseas worker ? There are many available visa options that may be just right for you depending on your location and occupation.

Introduction

The TSS – 482 Visa is one of Australia’s most popular visas. The 482 Visa allows skilled workers to come to Australia and work for an approved business for up to four years. A business can sponsor someone for this visa if they cannot find an Australian citizen or permanent resident to do the skilled work.

A business must become approved as a Standard Business Sponsor in order to sponsor an overseas worker.

You can work in your nominated occupation for your approved Australian sponsor under one of the following:

  • the Short-Term stream
  • the Medium-Term stream
  • the Labour Agreement stream

The nominated position will determine which stream you fall into. You can check what stream your occupation fall into in the  Combined List of Eligible Skilled Occupations.

Entitlements

The Temporary Skill Shortage (Subclass 482) Visa is a temporary visa which permits the holder to live in Australia, while working full-time only for the sponsoring employer, in the nominated position.

With this visa, you can:

  • work in Australia only for your sponsor for up to 4 years
  • study 
  • travel to and from Australia as many times as you want while the visa is valid
  • if eligible, apply for permanent residence

You can bring your family with you (they can work and study) and you can travel in and out of Australia as often as you like.

Requirements

To apply for the Temporary Skills Shortage (TSS) visa subclass 482, you must be sponsored by an approved employer and meet a number of other requirements:

Occupation

The role that the employer wants to fill must appear as an occupation on the Combined List of Eligible Skilled Occupations. The salary for the nominated position must meet two requirements.

  • Firstly, the remuneration must be above the Temporary Skilled Migration Income Threshold (TSMIT). This threshold is set by DIBP each year and is currently $53,900 plus superannuation.
  • Secondly, the proposed salary must be within the market rate for the role

Age

There is no age limit for the 482 Visa. This is an important fact of the 482 Visa and is also one of the major advantages of this visa.  However, only applicant under 45 years old can apply for Permanent Residency after 3 years of work under the same employer applying for the ENS (subclass 186) Visa – Transition Stream

Applicant Skills

The applicant must have the skills required to fulfill the role.  All TSS visa applicants are required to have a relevant qualification and a minimum of two years’ relevant work experience. 

English Level

If applicants are not from an exempt country (UK, USA, Canada, NZ or Ireland), they will also need to meet English language requirements.

How long can you stay?

The TSS visa has a short-term stream and a medium/long – term stream. 

Applicants with occupations on the Short-Term Skilled Occupations List (STSOL) are eligible for visas of up to two years (renewable once, for a further two years), whilst those on the Medium and Long-Term Strategic Skills List (MLTSSL) can apply for up to four years, with eligibility for permanent residency after three years.

Processing Time – 14 to 30 days

Introduction

The Employer Nomination Scheme (subclass 186) visa is a permanent residency visa for skilled workers.  To be eligible for this visa, a skilled individual must be nominated by an Australian employer.  This visa involves a two-step process:

  • a Nomination by an Australian employer; and
  • a Visa Application by the skilled overseas worker. 

To apply for the ENS (sub. 186) Visa, the applicant must be nominated in one of the positions included in the Medium and Long Term Strategic Skills List.

Entitlements

This visa provides the holder with Australian permanent residency. Although the visa is granted based on the holder being skilled in a specific occupation, once granted, the visa doesn’t require you to seek or maintain employment in this occupation.

With this visa, you can

  • stay in Australia indefinitely
  • work and study in Australia
  • enrol in Australia’s public health care scheme (Medicare) 
  • sponsor eligible relatives to come to Australia
  • apply for Australia Citizenship, if eligible

You can bring your family with you (they can work and study) and you can travel in and out of Australia as often as you like.

Requirements

Age:

maximum age requirement of 45 at the time of application will apply to Direct Entry

English Level: 

Competent English – IELTS (or equivalent test) score of 6 in each component.

The subclass 186 visa has two main streams, the Temporary Residence Transition (TRT) Stream and the Direct Entry (DE) Stream. Each stream has different criteria.

1. The Temporary Residence Transition Stream

To apply in the TRT stream, you must be the holder of a 457 visa or a 482 visa. Your occupation must be on the included in the  Medium and Long Term Strategic Skills List (unless your Visa was approved before the 18 April 2017).

You must have worked for your sponsor for three years whilst the holder of one of these visas (482 or 457), in the same occupation with you nominating employer who wants to offer you a permanent position in that occupation.

2. The Direct Entry Stream

The Direct Entry stream is for applicants who have not worked on a 457 visa/ TSS 482 Visa with their nominating employer for 3 years, but who are formally qualified in their occupation and have worked for at least three years at a skilled level in their occupation included in the Medium and Long Term Strategic Skills List.

Applicants in the DE stream must have an occupation on the MLTSSL  and are required have: 

  • a relevant qualification at the skill level required for the job
  • a minimum of three years relevant work experience
  • must a positive skills assessment in this occupation before being able to apply. 

How long can you stay?

This is a permanent visa – it lets you stay in Australia indefinitely.

Your permanent residency starts:

  • on the day the visa is granted if you are in Australia
  • on the day you enter Australia on this visa if you are outside Australia

b. Secondary Applicant over 18: $2,025.00

c. Secondary applicant under 18: $1,010.00

Processing Time – 5 to 15 months

Introduction

The Skilled Employer Sponsored Regional (Subclass 494 ) Visa, came into force in November 2019 and replaced the Subclass 187 Regional Sponsored Migration Scheme Visa (RSMS).

The Subclass 494 visa is a Temporary Visa with 673 eligible occupations and is an exciting new pathway to Permanent Residence. This new regional visa allows you to transition to Permanent Residence after three years of you and your family living, working and/or studying in your regional area. This is basically everywhere in Australia except Melbourne, Sydney, and Brisbane.

A business must become an approved Sponsor in order to employ a 494 visa holder.

Entitlements

Once a 494 visa is granted, provided the visa holder maintains the nominated employment within the designated regional area, they can remain in Australia for up to five years, with a permanent residency pathway available after three years. Dependent family members may be included and must also live, work and study in a designated regional area..

With this visa, you can:

  • live, work and study in Australia only in designated regional areas of Australia for 5 years
  • travel to and from Australia as many times as you want while the visa is valid
  • apply for permanent residence after 3 years through the Permanent Residence Skilled Regional visa (subclass 191) – which commences on 16 November 2022.

You can bring your family with you (they can work and study).

IMPORTANT: Holders of the new provisional visas will also be unable to apply for most other visas (subclass 189/190/820/186) in Australia until they have completed at least three years in a designated regional area unless exceptional circumstances exist.

Requirements

To apply for the Skilled Employer Sponsored Regional Visa (SESR) visa, you must be nominated by an approved employer and meet a number of other requirements:

Occupation

The role that the employer wants to fill must appear as an occupation on the Regional Occupation List  (goes to resources) 

Salary

The salary for the nominated position must meet two requirements.

  • Firstly, the remuneration must be above the Temporary Skilled Migration Income Threshold (TSMIT). This threshold is set by DIBP each year and is currently $53,900 plus superannuation.
  • Secondly, the proposed salary must be within the market rate for the role.

Age

maximum age requirement of 45 at the time of application

Applicant Skills

You must:

  • have a relevant qualification at the skill level required for the job
  • Have been employed in the nominated occupation for at least 3 years on a full-time basis and at the skill level required for the nominated occupation. 
  • You also must have a positive skills assessment at the time of application

English Level

Competent English – IELTS (or equivalent test) score of 6 in each component.

How long can you stay?

This is a provisional visa. You can stay in Australia for a period of 5 years from when your visa is granted.  You can’t stay in Australia longer by extending this Visa, you can apply for permanent residence after 3 years from the time your visa is granted applying for the Subclass 191 Permanent Residence (Skilled Regional) Visa

Introduction

The Training (Subclass 407) Visa is a short stay visa for applicants to complete an occupational training or professional development in Australia. The Training visa allows people to undertake occupational training in Australia to meet occupational registration or licensing requirements, to enhance skills in their occupation or for capacity building overseas.

This visa allows applicants to work for an approved sponsor in a specific occupation, whilst partaking in a structured training program provided by the. employer. There are three streams through which an applicant can obtain a 407 visa:

  • Workplace Based Occupational Training: Applicants who have recent qualifications and/or experience intending to take part in workplace-based training to enhance their skills in their current occupation, area of tertiary study or field of expertise.
  • Training that promotes capacity building overseas: this pathway is for applicants who wish to participate in a professional development training program in Australia and Students who need to complete an internship as part of their qualification and government-supported workplace trainees.
  • Work-based training for registration: Applicants hoping to gain registration/licencing as part of their occupational requirement (trade occupations)

Entitlements

The Training (Subclass 407) Visa is a temporary visa which permits the holder to live in Australia, while completing a training for the sponsoring employer, in the nominated position.

With this visa, you can:

  • Live in Australia for up to 2 years and complete the training specified in your application
  • Leave and re-enter Australia frequently till the visa is valid
  • Bring eligible family members to accompany you in Australia

Requirements

To apply for the Training (Subclass 407) Visa, you must be nominated by an approved employer and meet a number of other requirements:

  • Have turned 18 (or can demonstrate exceptional circumstances)
  • Have functional English
  • Hold private health insurance
  • Have access to sufficient funds to support themselves and the accompanying members of the family unit while in Australia
  • Genuinely intend to stay temporarily in Australia for the intended purpose
  • Meet health and character requirements

How long can you stay?

The visa is generally valid for stay in Australia for up to 2 years depending on your Training Plan. The visa is subject to condition 8102 which forbids work apart from the training specified in the visa application.
