Child visa (101, 864, 102)

Children of an Australian citizen, Australian permanent resident or eligible New Zealand citizen may be able to migrate to Australia.

There are 3 types of Australian Child Visas that might be eligible for your child to apply:

Subclass 864

Child Visa - onshore

If you are an Australian citizen or permanent resident and you have a child who lives overseas and you want to bring him over to Australia to live permanently, this could be the visa for him.

Subclass 101

Child Visa - Offshore

If you are an Australian citizen or permanent resident and you have a child who lives overseas and you want to bring him over to Australia to live permanently, this could be the visa for him. This is a Permanent Visa and the application must be lodged from Offshore.

Subclass 102

adoption visa

This is for children adopted outside Australia from an Australian citizen or permanent resident. This visa allows them to come and live in Australia with their adoptive parent. This is a Permanent Visa and the application must be lodged from Offshore.

FAMILY VISA

Child Visa - Offshore (subclass 101)

If you are an Australian citizen or permanent resident and you have a child who lives overseas and you want to bring him over to Australia to live permanently, this could be the visa for him. This is a Permanent Visa and the application must be lodged from Offshore.

Your child must be single, younger than 18 years of age (or a full-time student between 18-25 years of age or older than 18 but unable to work due to disability and dependent on the sponsoring parent) and sponsored by their parent or their parent’s partner who is an Australia Citizen or Permanent Resident. FAMILY VISA

Child Visa - onshore (Subclass 864)

If you are an Australian citizen or permanent resident and you have a child who lives overseas and you want to bring him over to Australia to live permanently, this could be the visa for him.

This is a Permanent Visa and the application must be lodged from Onshore.
Your child must be single, younger than 18 years of age (or a full-time student between 18-25 years of age or older than 18 but unable to work due to disability and dependent on the sponsoring parent) and sponsored by their parent or their parent’s partner who is an Australia Citizen or Permanent Resident.

FAMILY VISA

Adoption Visa (subclass 102)

This is for children adopted outside Australia from an Australian citizen or permanent resident.

This visa allows them to come and live in Australia with their adoptive parent. This is a Permanent Visa and the application must be lodged from Offshore.

CHILD VISA

Requirements

The requirements change in accordingly with the visa subclass you are applying for. The main requirements for this Visa are:

Be sponsored by an eligible parent or their parent’s spouse or de facto partner.

Be younger than 18, over 18 and under 25 years and studying full time, or older than 18 but unable to work due to disability and dependent on the sponsoring parent.

Not be married or in a De Facto Relationship.

How long can you stay?

This is a permanent visa and let the holder of the Visa stay in Australia indefinitely.
It gives permanent resident on the day the visa is granted.

Permanent residency for citizenship purposes starts:

  • on the day the visa is granted if you are in Australia
  • on the day you enter Australia on this visa if you are outside Australia
